Owl Homes Terms and Conditions of Promotions and Sales Schemes 
  1. Offers and Incentives: 
From time to time we will advertise promotions or incentives to buyers looking to purchase an Owl home. The following terms and conditions apply: 
  • Offers are available on selected plots only and we reserve the right to withdraw these at any time until a valid reservation is made. Not all homes are applicable to promotions - please speak to a sales advisor for clarification at the time of enquiry.
  • Where advertised as stamp duty paid or a cashback incentive, the offer is a lump sum that will be paid to the buyer upon legal completion. 
  • Stamp duty paid promotions are only eligible on purchaser’s where this will be the only home. It is not eligible for those buying an Owl home as a second home. 
  • Any promotions cannot be used in conjunction with any other offer or incentive. 
  • We reserve the right to amend or withdraw promotions at any time. 
  • Where applicable, flooring and/or turf may have already been installed in the plot. If this is not the case and it is being promoted that flooring is included within the promotion, it will be installed ahead of legal completion. Final selection of what is installed may be limited due to availability and/or depending on the build status of your selected home. 
    2. Assisted Move: 
  • We instruct independent valuations from two registered local high street estate agents. If you have a preference for which agent you’d prefer, we’re happy to include them. 
  • The valuation is based on achieving a sale within 6 - 8 weeks 
  • If there is more than a 5% difference in valuations, a third valuation will be instructed and an average selling price will be offered 
  • Once the valuation selling price is confirmed, we allow 48 hours for you to accept the selling price of your home.
  • We do not hold the Owl home until you have accepted the valuation selling price of your home and paid the reservation fee. 
  • Once your reservation is confirmed, we will hold your preferred Owl home for a period of 6 weeks, while we work with the estate agent to secure the right offer for your home 
  • We review progress at the end of 4 weeks If you have accepted an offer for your home, we will confirm your full reservation and issue contracts to your solicitors 
  • If you have not received or accepted an offer within 4 weeks, we will identify any actions to increase viewings and secure an offer. This may include produce reduction in order for us to extend the offer for an additional 2 weeks. If you prefer not to take additional action, we will cancel your reservation and refund a percentage of the reservation fee you paid 
  • Properties that may not qualify for this programme include commercial property or residential homes above commercial property. 
  • We reserve the right to withdraw this promotion at any time
  • The agreed estate agents commission for promoting and selling your home will be paid by Owl Homes provided your reservation progresses to exchange of contracts. 
  • In the event that you cancel your reservation, any fees due to the estate agent will be your responsibility to pay. 
     3. Part Exchange
  • Part Exchange is only available on selected plots and developments in England, and Wales and is subject to our standard terms and conditions. Part Exchange will only be available where the existing property being traded in is no more than 70% of the selling price of the plot you are considering purchasing. 
  • All properties shall need to be considered for Part Exchange on an individual basis. Owl Homes are under no obligation to make an offer. 
  • Any offer made to purchase your existing property will be at fair value and will be based on a presumed sale of 4 to 6 weeks. Our offer will be subject to a RICS survey and an independent valuation. 
  • To be considered for Part Exchange you will need to have completed the Part Exchange application form in full, a Reservation Agreement and have paid your Reservation Deposit. 
  • You will need to provide access to our appointed estate agents, Sales Manager or our representative within 5 working days for the purposes of valuations and inspection of your existing property. 
  • Following valuation and inspection of your existing property we will make you a verbal offer. Your acceptance will be required within 2 working days and any written offer must be returned within 2 working days of receipt. Upon acceptance your Reservation Agreement will be processed. If you do not accept our offer, your application for Part Exchange and your reservation on the new property will be cancelled. 
  • Note any offer made to you by us under the Part Exchange scheme is subject to any necessary further enquires or reports. 
  • You will need to ensure your solicitor is instructed to proceed on your behalf upon acceptance of our offer and to meet our 42 day exchange requirement. 
  • You agree to cancel any existing arrangements with any agents and any agents’ fees or commissions and VAT that may have been incurred by you prior to our agreement will remain your responsibility. Owl Homes will not accept liability towards any such costs or charges. 
  • Both your purchase of the new home and our Part Exchange agreement are subject to contract until the exchange has taken place on both transactions. 
  • We will market your existing property prior to your move into a new Owl home. You agree to allow reasonable access to your existing property to facilitate the resale (subject to agreed appointments) and to the erection of a “for sale” sign.
  • Any estate agents appointed by ourselves to market your existing property will be acting on our behalf and should the complete transaction proceed to mutual legal completion any fees and commissions for the appointed agents will be met by Owl Homes. 
  • Should either party withdraw from the transaction but you continue to sell your existing property to any individual introduced by our appointed agents during the period of our instructions, and any such sale proceed to a legal completion, you would be responsible for the agents’ commission and VAT. 
  • Certain items are deemed fixtures and fittings within your existing property and must remain within the property and are included in our offer. Such items will be set out within the Property Inspection Form. 
  • Your existing property must continue to be maintained internally and externally to an acceptable standard until legal completion and on legal completion must be left clean and tidy including the garden, loft and any outbuildings with only the agreed items remaining. 
  • On the day of legal completion you will not receive the keys to your new home until completion has taken place on your existing property and only then when it is confirmed that you have left the keys as set out in the Property Inspection Form with our appointed estate agent or ourselves, along with any alarm codes. You will be notified prior to legal completion where these keys are to be left. Any keys not provided may necessitate a locksmith being instructed on our behalf to replace locks and supply keys, the cost of which would be recovered from you. q) You will be responsible for all service company invoices up to and including the day of legal completion. Please ensure you have had all your meters read in order that the final bills can be forwarded on to you for settlement. We will not accept any bills or invoices for periods of consumption prior to completion date. 
  • Full vacant possession of your existing home will be required upon legal completion.

The Site has two levels of access: -

General Access Level: you do not need to register to use this area of the Site and can access general information about Owl Homes and information about our products and services. The Site has a search tool that enables you to find properties that match specified criteria and access to detailed information on each of the developments including site and floorplans.

Secure Area Level: Access will only be provided to you on a user name and password protected basis.

COPYRIGHT

The copyright in the content of all the pages on the Site is owned by Owl Homes and its licensors (except where otherwise stated). Reproduction of part or all of the contents in any form is prohibited other than in accordance with the following permissions.

Owl Homes authorises you to carry out the following actions, provided that you comply with the User Obligations and Conduct (as stated above): -

(a) view and display the content of the Site; and

(b) print or download to a local or network hard drive extracts from or whole pages for your personal use.

You must not modify the paper or digital copies of any materials that you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

You are not permitted to incorporate any materials, or any part of the materials, from the Site to any other work or publication, whether in hard copy or electronic or any other form.

No part of the Site may be distributed or copied for any commercial purpose.

 

RELIANCE ON INFORMATION POSTED

Owl Homes operates a policy of continual product development and all specifications outlined on this Site are indicative only.

Any alterations to the specifications will be of equal or greater value and Owl Homes reserves the right to implement changes without warning.

Details on this Site are prepared with all due care for the convenience of intending purchasers. The information is intended as a preliminary guide only and should not be relied upon.

The Site contains photographic illustrations taken from various Owl Homes developments. They are intended as a guide, indicating the typical style of property and finish. Customers should note that any computer-generated image or photograph on this Site does not necessarily represent the actual finishing’s /elevation or treatments, furnishings and fittings at any individual development.

Room measurements given are approximate only. Floor plans, dimensions and specifications on any particular development are correct at the date noted on the individual illustration.

Nothing contained on this Site shall constitute or form part of any contract.

For specific and up to date details relating to any individual development, you are encouraged to speak to the Owl Homes representative at the development.

 

SITE AVAILABILITY

Owl Homes reserves the right to withdraw or amend the service provided on the Site without notice. Owl Homes will not be liable if for any reason the Site is unavailable at any time or for any period. Owl Homes aims to update the Site regularly, and may change the content at any time. If the need arises, Owl Homes may suspend access to the Site, or close it indefinitely. Any of the material on the Site may be out of date at any given time, and Owl Homes is under no obligation to update such material.

 

HYPERLINKS

Where the Site contains links to other sites and resources provided by third parties, these links are provided for your information only. Owl Homes has no control over the contents of those sites or resources, and accepts no responsibility for them or for any loss or damage that may arise from your use of them.

 

GENERAL

These Terms, the Privacy Policy and any other specific terms of use appearing anywhere on the Site constitute the entire agreement of the parties in relation to the use of the Site, and the Terms supersede any other agreements between the parties in this matter. If there is any conflict between these Terms and any information posted anywhere on the Site, these Terms shall prevail.

If any of these Terms should be determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these Terms are intended to be effective, then to the extent that the term or condition is illegal, invalid or unenforceable, it shall be severed and deleted from the Terms and the remaining Terms shall survive, remain in full force and effect and continue to be binding and enforceable.

 

VARIATIONS

Owl Homes may revise these Terms at any time by amending this page. You are expected to check this page from time to time to take notice of any changes Owl Homes made, as they are binding on you.
